It sounds like it is not the capo..... but the height of the strings in the nut..
Read through this and see how yours compares.... Oh, and are you placing the capo almost RIGHT ON the first fret? You should be...

Do you have the correct capo for your guitar? Shubb makes a number of different ones specifically for steel string, classical, electric, etc.

I've got some Shubbs, and have never had a problem with any of them...

Did you try adjusting the tension screw on the capo?

For what it is worth - I use a Shubb on the 1st fret all the time when playing hymns at church and never have a problem.

My new Lowden had super high action when I first got it and even then I didn't have any problems with the capo.

Which strings sound muted when using the capo?

Which Shubb are you using? I find the Deluxe (with the little wheel as a fulcrum rather than the pointy thingy) is more consistent fret-to-fret--but you still need to tweak the tension when you move it. I use it only for recording unless I have access to a music stand or other convenient surface onstage on which to park it--otherwise I use a Kyser simply because I can clamp it to my headstock w/o adjustments.

One other tip, I place my capos so the leading edge of the FB pad is directly over the fret and hold the pad flat over the fret (contacting all the strings securly) while I engage the locking mechanism. If the mechanism doesn't feel like it is getting a snug fit I relese it, tighten the screw a bit and try again.

some more words......
Can NOT adjust the spring tension.... (stretches strings)
Made from cheap "pot metal" (cast alloy of some sort) AND BREAKS
and goes flying off of the headstock...... (I have seen it happen more than
once..... dinging guitar)
Clamping to the headstock on a nice guitar can (and does) leave marks.
To each his own..... but NO KYSER for me.. none, zip, nadda....
