Default this is or is it stupid?

i got a letter from musicians friend today, saying i may owe sales tax on a purchase i made the previous year for $15.99 and must be reported on my PA income tax- seriously, these clowns want to mess me up for .96 cents? like its my fault anyway- geez

If there is a sales tax issue, they are supposed to collect it. I really doubt the state is going to bother with such a small amount. It would cost more to process the whole transaction than the state will collect.

Most states require sales tax to be collected for out of state purchases. Some refer to it as a "use tax". Check your state income tax forms and you'll likely find an entry or an additional form for you to report these purchases and pay the tax at the time you pay your income tax.

While they have no intention of harassing you, you will likely find out that they got pressured by a state tax agency and forced or settled to go after past year sales tax revenue.

For 96 cents that is stupid. The cost of preparing and sending a letter would be more than 96 cents. For small amounts they should adjust their invoices such that they record that tax was paid and pay the sales tax themselves rather than harass a whole bunch of soon-to-be ex-customers.

I received the same notice of PA tax from MF. First time any similar notice was sent.

Line 25 of Form PA-40 is where you pay tax on out-of-state purchases. Philly and Allegheny Co also want their vig of 2% and 1% resp. Most years I ignored it. Some years I used the table on the line 25 worksheet based on taxable income.

I don't know how they can enforce collection of the tax unless they buy Amazon, Ebay, Paypal, etc records.

If this was news to you, just continue ignoring it.

Tax laws have changed for PA. For example, Sweetwater now collects sales tax for shipments to PA. I suspect eventually all retailers will start in order to remain in compliance.

This is how it should be. The concern that sells the product should be reponsible for applying the appropriate state tax and collecting it.

Income tax should be... well, tax on one's income. Period!

As I understand it, the vendor owes the sales tax. They normally pass the cost on to the buyer. In this case, they failed to do it. It isn't your fault; it's their's. They owe the money, not you.

It is far simpler for the State to deal with a comparatively few vendors than each purchaser.

If MF did not collect any tax it may not be their responsibility to pay it.
Actually it depends of the particular statutes (dealing with out of state sales) in place in each particular state.
Some states require the seller to collect and pay the tax, some states require the purchaser to pay the tax.

Yeah, and the come armed with a P Bass in each hand with wireless connections to the biggest amps you will ever see or gear. They play on sight and ask questions later!
