Without looking at it or seeing pix its not possible to diagnose.
Put a straight edge on the frets and see if there is a dip. With Truss rod adjusting and A proper set up may only be necessary.
From 97 is a glued in neck I am pretty sure. From what you describe it sounds like it is a candidate for a couple hundred dollar neck reset.

Can you return it?

Without seeing the guitar it's hard to know but my guess is that the string slots in the nut could be filed a little deeper and that the saddle could be lowered as well. Probably not much but enough to make the guitar more comfortable to play.

Take it to a shop that specializes in acoustic instruments.
