Technically speaking...
The item is out of stock, because, as you said - it is a '51. The advertised item is not was was displayed. It also wasn't hers (she didn't own it). Regardless of what she said in the email, the owner of the guitar never listed it for sale. I actually side with the owner in this case. |

Not to rag on you, but if you EVER find an eBay deal, NEVER EVER post it online till it's in your hands. Trust me on this. And even then there can br nightmare scenarios.

I agree with Ted and others. Great deals do not come along often but.....
Recently I bought an ES137 off Ebay from a touring musician. I was the only bidder and my initial $750 offer was the only one. I knew it was too low. He knew it was too low. I offered to pay more or the opportunity to cancel the sale if he wanted. I tell this story not to highlight anything other than to point out that Karma is a precious thing. The Karma police are usually not good to you. |

Did you see the pictures of the guitar. Even at the price I "tried" to pay, there was absolutely no guarantee the guitar was even playable, or how much work and money was going to have to go into it. If the pickups worked, the pots, etc. All of which if replaced cost money AND reduce the value of the guitar.
And yes, if I see somebody drop money I immediately tell them. Besides, the gal lied several times so I think I'm the one who's taking the high road.

This happened to me on ebay once. A zero feedback seller, I won the auction, he backed out of the deal. We had a contract! I wanted that guitar! But the payment was refunded, so it's a tough argument telling a judge that you've been "damaged." What have you lost? No damage, no case.

Sorry, but I disagree. When I enter into a legal agreement, I expect the other party to hold up their end of the bargain. That's fair play.

You guys crack me up, yea, let's take a pole! She lied, both to eBay and me, she breached the Contract with another lie. Oh, just so we're clear, she relisted it as a '56 not a '51. So, what do you think, now she's smarter just enough but still has no idea what year it is? She's a crook, and the reason she does it and get's away with it is because of people like you with no spine. Grow up and enter the real world.
