Hey guys, I'm new to the forum and I'm not going to Taylorstock, but I wanted to make a Tee Shirt design. I'm not finished, this will be the front logo. Tell me what you think. Give me some ideas for the back. I used an idea Ryan had for this logo. I was thinking the same thing Ryan when I read your post. ANyways, will post the back later tonight.

I responded in the General discussion thread with this shirt design, but the gist of what i said there was

this is exactly the type of design i had in mind
I would do anything to get the shirt with the silhouette cowboy on it...fantastic subtlety and a great t-shirt motif.

It is an excellent design, but...
You'd have to get Taylor permission to use their logo; I'd bet they wouldn't mind for a limited commemorative design like this, but you can't presume.
Also, while I don't have my catalog handy, I'd bet that the photographer owns the copyright for that image, and you'd have to get his permission separately.
On the other hand, maybe YOU could license the design back to Taylor for a new TaylorWare shirt! ;)

My two cents. In another life I designed t-shirts for my rugby club which consisted of about 100+ people. We sold our shirts at tournaments and as fundraisers for the club. The most we ever produced was 500 which sold in a couple of days. I used many different images without permission. We never advertised to the public nor were they displayed on the internet. We never had any issues with using images without permission. We were too small to be concerned with and the profit margin was very small. I can see where Taylor may have an issue because they also sell their Taylorwear. I suggest we use the old saying "it's easier to ask for forgiveness than permission" when it comes to the non Taylor images. Perhaps Taylor will look the other way if we approach them in advance. Besides, we are not a corporation or private business that can be sued. Mr. Rogers can put out a disclaimer that he has nothing to do with the t-shirts and wash his hands of any liability. I'm not a lawyer and far from being the most intelligent person in this forum. But I have done this before and succeeded without a problem.

Ummm... Let's not do that. :( While I appreciate the enthusiasm Chris, I wont support/allow anything underhanded, shady, or dishonest to happen with the Forum's name attached. We'll be legit or it just wont happen.
While I like JavaMan's design, I think that artwork could be misinterpreted from a distance. :eek: Anyone else see what I'm talking about?

Chris, I suspect that your rugby team simply managed to stay under the radar of the people whose images it used. Also, those images may have been copyrighted but not trademarks. That doesn't make it okay to use them, but they may not be monitored quite as closely.
I'm not a lawyer, but I understand that trademarks need to be protected aggressively if they're to be protected at all. I think that if a trademark owner has knowledge of someone using it inappropriately or without permission and they don't take action, that makes it harder for them to take action against others. There's also the issue of copyright law, which I think is separate from trademark law.
There was a story several years ago of a day care center near Disney World in Orlando that had Disney characters painted on the walls of their rooms. When Disney found out they had the day center paint over characters because they had been used without prior permission. Disney got some bad press for this, but I read that they were in a bind because of the law.
I don't know if the changing of money makes any difference. The copyright law has provisions for what is called "fair use," but I don't think it extends to trademarks.

As far as the design, I'm with you, J.R. No sense in getting Taylor all fired up about something. They're supporting this forum with events like Taylorstock, so why upset them?
As far as the t-shirt design, I didn't see it at first, but I see it now. Geez...

I think that there will always be someone somewhere that will misinterprete things. How many of the great masters had their art repressed due to someone reading things into their art that just wasn't there. Is this another form of artistic repression? Where will it all end? :(
Personally, I think it's a very creative and dynamic design. I'd wear it and what's more, I wouldn't give a d@mn what anyone read into it!
